On 6 February 2020, the Court of Appeal dismissed an appeal against PCB’s client. The Court of Appeal found that there was no basis for it to interfere with the judgment of the Commercial Court by which a disclosed principal was permitted to bring a claim on an agreement made between the principal’s agent and the appellant. The Court rejected the appellant’s case that the express terms of the agreement meant that only the agent had the right to bring such a claim and therefore that the claim brought in the Commercial Court by the claimant as principal should have failed.
